1. เกี่ยวกับผู้ให้บริการ
Beavy ("เรา", "บริษัท") ให้บริการโดย บริษัท ดรีม แอนด์ เอเบิล จำกัด ซึ่งจดทะเบียนในประเทศไทย ("ผู้ให้บริการ")
การใช้งาน Beavy ไม่ว่าจะผ่านเว็บไซต์ แอปพลิเคชัน หรือช่องทางอื่นใด ถือว่าท่านยอมรับข้อกำหนดฉบับนี้ทั้งหมด
2. คำนิยาม
- "บริการ" หมายถึง แพลตฟอร์ม Beavy สำหรับบริหารจัดการงานบริการ ทีมช่าง ลูกค้า และเอกสารที่เกี่ยวข้อง
- "ผู้ใช้งาน" / "ท่าน" หมายถึง บุคคลหรือนิติบุคคลที่สมัครใช้บริการ
- "บัญชี" หมายถึง บัญชีผู้ใช้งานที่ลงทะเบียนเพื่อเข้าถึงบริการ
- "ข้อมูลของท่าน" หมายถึง ข้อมูลที่ท่านหรือทีมงานของท่านบันทึกเข้าสู่ระบบ เช่น ข้อมูลลูกค้า งาน และรายรับ-รายจ่าย
3. คุณสมบัติผู้ใช้งาน
ท่านต้องมีอายุ 20 ปีบริบูรณ์ขึ้นไป หรือเป็นผู้มีอำนาจกระทำการแทนนิติบุคคล และมีความสามารถตามกฎหมายในการทำสัญญาผูกพัน
4. การสมัครใช้บริการและบัญชีผู้ใช้
- ท่านต้องให้ข้อมูลที่ถูกต้อง ครบถ้วน และเป็นปัจจุบันในการสมัครใช้บริการ
- ท่านมีหน้าที่รักษาความปลอดภัยของรหัสผ่านและข้อมูลเข้าสู่ระบบของท่านเอง
- ท่านรับผิดชอบต่อกิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของท่าน รวมถึงการกระทำของพนักงานหรือทีมช่างที่ท่านให้สิทธิ์เข้าถึงระบบ
5. แผนการใช้งานและการชำระเงิน
- Beavy เสนอแผนทดลองใช้ฟรี 60 วัน โดยไม่ต้องผูกบัตรเครดิตล่วงหน้า
- หลังพ้นระยะทดลองใช้ฟรี บริการจะเรียกเก็บค่าบริการตามแผนที่ท่านเลือก (เช่น Team หรือ Pro) เป็นรายเดือนหรือรายปีตามที่ระบุไว้ ณ ขณะสมัคร
- การชำระเงินสำหรับลูกค้าต่างประเทศดำเนินการผ่าน Stripe ส่วนลูกค้าในประเทศไทยอาจชำระผ่านช่องทางที่บริษัทกำหนด เช่น พร้อมเพย์
- ราคาบริการอาจมีการเปลี่ยนแปลง โดยบริษัทจะแจ้งให้ทราบล่วงหน้าตามสมควรก่อนมีผลบังคับใช้กับรอบบิลถัดไป
- ท่านมีหน้าที่ชำระค่าบริการตามกำหนด หากไม่ชำระเงินตามกำหนด บริษัทสงวนสิทธิ์ระงับหรือยกเลิกการเข้าถึงบริการ
6. ข้อมูลและความเป็นเจ้าของ
- ข้อมูลของท่านที่บันทึกเข้าสู่ระบบ (เช่น ข้อมูลลูกค้า งาน เอกสาร) ยังคงเป็นกรรมสิทธิ์ของท่าน
- บริษัททำหน้าที่เป็นผู้ประมวลผลข้อมูล (data processor) ตามคำสั่งของท่านในฐานะผู้ควบคุมข้อมูล (data controller) สำหรับข้อมูลลูกค้าปลายทางของท่าน
- ท่านรับรองว่าท่านมีสิทธิโดยชอบธรรมในการนำข้อมูลลูกค้าของท่านเข้าสู่ระบบ และจะปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้อง
7. ข้อห้ามในการใช้งาน
ท่านตกลงจะไม่กระทำการดังต่อไปนี้:
- ใช้บริการเพื่อวัตถุประสงค์ที่ผิดกฎหมาย
- พยายามเข้าถึงระบบ ข้อมูล หรือบัญชีของผู้อื่นโดยไม่ได้รับอนุญาต
- ทำวิศวกรรมย้อนกลับ (reverse engineer) แก้ไข หรือคัดลอกซอฟต์แวร์ของบริการ
- ใช้บริการในลักษณะที่เป็นภาระต่อระบบเกินสมควร หรือรบกวนการทำงานของผู้ใช้งานรายอื่น
8. ทรัพย์สินทางปัญญา
ซอฟต์แวร์ โลโก้ เครื่องหมายการค้า และเนื้อหาทั้งหมดของ Beavy เป็นทรัพย์สินของผู้ให้บริการ ห้ามคัดลอก ทำซ้ำ หรือดัดแปลงโดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษร
9. การยกเลิกบริการ
- ท่านสามารถยกเลิกบริการได้ทุกเมื่อผ่านหน้าบัญชีผู้ใช้งานหรือติดต่ออีเมลของบริษัท
- บริษัทสงวนสิทธิ์ระงับหรือยกเลิกบัญชีของท่าน หากพบว่าท่านละเมิดข้อกำหนดฉบับนี้ หรือไม่ชำระค่าบริการตามกำหนด
- เมื่อยกเลิกบริการ ท่านสามารถร้องขอส่งออกข้อมูลของท่านได้ภายในระยะเวลาที่บริษัทกำหนด ก่อนข้อมูลจะถูกลบออกจากระบบ
10. ข้อจำกัดความรับผิด
บริการนี้ให้บริการ "ตามสภาพที่เป็นอยู่" (as is) โดยไม่มีการรับประกันใดๆ ทั้งโดยชัดแจ้งหรือโดยนัย บริษัทไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายที่เกิดขึ้นโดยบังเอิญ หรือความเสียหายที่เป็นผลสืบเนื่อง อันเกิดจากการใช้หรือไม่สามารถใช้บริการได้ เท่าที่กฎหมายอนุญาต
11. การเปลี่ยนแปลงข้อกำหนด
บริษัทอาจปรับปรุงข้อกำหนดฉบับนี้เป็นครั้งคราว โดยจะแจ้งให้ทราบผ่านอีเมลหรือประกาศในระบบ การใช้บริการต่อหลังจากการเปลี่ยนแปลงมีผลบังคับใช้ ถือว่าท่านยอมรับข้อกำหนดที่ปรับปรุงแล้ว
12. กฎหมายที่ใช้บังคับ
ข้อกำหนดฉบับนี้อยู่ภายใต้บังคับของกฎหมายไทย ข้อพิพาทใดๆ ที่เกิดขึ้นให้อยู่ในเขตอำนาจของศาลไทย

1. About the Provider
Beavy ("we", "the Company") is provided by Dream and Able Co., Ltd., registered in Thailand ("Provider").
By using Beavy through the website, application, or any other channel, you agree to be bound by these Terms in full.
2. Definitions
- "Service" means the Beavy platform for managing field service jobs, technician teams, customers, and related documents.
- "User" / "you" means the individual or entity registering to use the Service.
- "Account" means the registered account used to access the Service.
- "Your Data" means data you or your team enter into the Service, such as customer records, jobs, and financial records.
3. Eligibility
You must be at least 20 years old, or authorized to act on behalf of a legal entity, and have the legal capacity to enter into a binding agreement.
4. Registration and Account
- You must provide accurate, complete, and current information when registering.
- You are responsible for maintaining the confidentiality of your password and login credentials.
- You are responsible for all activity under your account, including actions by staff or technicians you grant access to.
5. Plans and Payment
- Beavy offers a 60-day free trial with no credit card required upfront.
- After the trial period ends, the Service will bill according to the plan you selected (e.g. Team or Pro) on a monthly or annual basis as specified at signup.
- Payments for international customers are processed via Stripe. Domestic Thai customers may pay through channels designated by the Company, such as PromptPay.
- Pricing may change from time to time; the Company will provide reasonable advance notice before changes take effect on your next billing cycle.
- You are responsible for timely payment. The Company reserves the right to suspend or terminate access for non-payment.
6. Data and Ownership
- Your Data entered into the Service (customer records, jobs, documents, etc.) remains your property.
- The Company acts as a data processor on your instructions, where you act as the data controller for your end customers' data.
- You represent that you have the lawful right to enter your customers' data into the Service, and that you will comply with applicable data protection laws.
7. Prohibited Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to access another user's systems, data, or account without authorization.
- Reverse engineer, modify, or copy the Service's software.
- Use the Service in a way that places unreasonable load on the system or disrupts other users.
8. Intellectual Property
All software, logos, trademarks, and content of Beavy belong to the Provider. Copying, reproducing, or modifying them without written permission is prohibited.
9. Termination
- You may cancel the Service at any time via your account page or by emailing the Company.
- The Company reserves the right to suspend or terminate your account if you breach these Terms or fail to pay fees when due.
- Upon cancellation, you may request an export of your data within the period specified by the Company before it is removed from the system.
10. Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. The Company is not liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, to the extent permitted by law.
11. Changes to These Terms
The Company may update these Terms from time to time, notifying you via email or in-app announcement. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Thailand. Any disputes shall be subject to the jurisdiction of the courts of Thailand.
